These Terms of Service (“Terms”) govern your use of the Azalea Stack LLC (“Azalea Stack,” “we,” “our,” or “us”) website at azaleastack.com, our booking flow, and our communications programs. By using the website, booking a call, or opting in to our communications, you agree to these Terms. Our Privacy Policy explains how we collect, use, and protect your personal information and is incorporated into these Terms by reference.
01. Use of the Website
You may use our website for lawful purposes only. You agree not to misuse the site, interfere with its operation, attempt to gain unauthorized access to any systems, or use automated tools to scrape or harvest content or data from it.
02. Client Engagements
These Terms cover the website and our communications only. Any services Azalea Stack performs for a client, including website builds, marketing systems, and custom software, are governed by a separate written agreement between Azalea Stack and that client. If these Terms conflict with a signed agreement, the signed agreement controls. Section 03 below describes the standard terms we offer; the signed agreement sets the terms that actually apply.
03. Standard Service Terms
Our standard client agreement works as follows. Nothing in this section creates an obligation on either party until both sign that agreement.
- •Build month: we build for roughly one month before billing begins. You owe nothing during that month, and the flat monthly starts only after you review the build and approve it.
- •Initial term: the Go High Level and Website services carry a 12-month initial term measured from the first billed month. Local SEO and other add-on services are month to month. After the initial term ends, every service continues month to month and either party may end it with written notice.
- •Fees: we charge a flat monthly fee per service, billed in advance. There is no setup fee and no charge before the build is approved. Custom software is quoted separately and billed at an hourly rate.
- •Early exit and buyout: you may end any service inside its initial term at any time by paying the remaining monthly fees for that service. There is no additional cancellation charge or penalty. Fees already paid are not refundable.
- •Website ownership: once the Website initial term is paid in full, whether through the 12 monthly payments or through a buyout, we transfer the site source code and move the deployment to accounts you control. While the service is active, we host the site and maintain its code as part of the monthly fee.
- •Go High Level and your accounts: your domain, your Google properties, your contacts, and your data remain yours at all times. If you end the Go High Level service, we transfer the subaccount we built to you and you contract with Go High Level directly for the platform fee thereafter.
04. Booking and Consultations
Booking a call through our website is free and creates no obligation on your part to purchase services, and none on ours to provide them. Appointment times are subject to availability, and we may reschedule when necessary. Quotes or estimates discussed during a consultation are not binding until set out in a signed agreement.
05. SMS Program Terms (A2P 10DLC)
By providing your mobile number and checking the applicable consent box, you agree to receive text messages from Azalea Stack. We operate two message programs, each with its own opt-in:
- •Booking & account messages: booking confirmations, appointment reminders, scheduling updates, and account or service notifications.
- •Marketing messages: offers, new services, and company updates, sent only if you separately opt in to marketing texts.
- •Consent to receive text messages is not a condition of booking a call or purchasing any service.
- •Message frequency varies.
- •Message and data rates may apply.
- •You may opt out at any time by replying STOP. Reply HELP for help, or contact us at 472-212-2796 or hello@azaleastack.com. Opting out of one program does not affect the other.
- •No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
- •Opting out of booking & account messages may affect our ability to send you timely scheduling updates.
- •Our Privacy Policy explains what we collect through these SMS programs, how we use it, and who we share it with.
06. Carrier Liability Disclaimer
Mobile carriers are not liable for delayed or undelivered messages. Delivery of SMS messages depends on effective transmission by your mobile carrier and is not guaranteed by Azalea Stack.
07. Intellectual Property
All content on this website, including text, graphics, logos, and design, is the property of Azalea Stack LLC and is protected by applicable intellectual property laws. You may not reproduce or reuse it without our prior written permission.
08. Disclaimers
The website and its content are provided “as is” without warranties of any kind, express or implied. Content on the site is for general information about our services and does not constitute professional advice or a binding offer.
09. Limitation of Liability
To the fullest extent permitted by law, Azalea Stack LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the website or our communications programs. Liability relating to client services, if any, is addressed in the applicable signed agreement.
10. Age Restrictions
Our website, services, and SMS programs are intended for individuals who are at least 18 years of age. By using the website or opting in to text messages, you represent that you are 18 or older.
11. Governing Law
These Terms are governed by the laws of the State of North Carolina. Any disputes shall be resolved in the appropriate courts located within North Carolina.
12. Changes to These Terms
We may modify these Terms at any time. Updated versions will be posted on this page with a revised effective date, and continued use of the website constitutes acceptance of the updated Terms.
